Mayor Ash- "“The biggest thing is that I care for the people of the community. I take it very seriously,” he said.
He cares for me by trying to stop my freedom of speech with his gavel at over 20 meetings where I expose Belfast City Hall Corruption and community abuse. Actively breeding and spreading as greedy ego's corrupt from the local to state to federal. Maine DEP and Belfast City Hall have approved massive direct run off flooding from business site after business site to private property and cover it up. They underestimated my unwavering courage to take on the corrupt, single handed, 3 1/2 years and counting. The City Attorney, Bill Kelly sending intimidating unethical letter after letter to discourage me. Mayor Ash, City Council and City Hall all taking the 5th at the ordering of the City Attorney from 12/2011. They buried the original 1966 development plans of the flood zone, flood plain for Seaview Terrace. On a hunch, I stormed the assessor office, unannounced and indeed found the assessor reviewing those very plans I had requested from the City Planner, Wayne Marshall 6 months before. The assessor did not know that I had never viewed these plans. It proves that this 1966 man-made ditch on my private property, for my private drainage,is actively, illegally and dangerously being used as a free, drowning outlet 35 years and counting for development runoff from miles outside of Seaview Terrace and inside Seaview Terrace is illegal and not a "natural stream or natural outlet". They have no right of ways or easements, deny doing it (water doesn't lie- I traced it myself and drew the map on my streamlined blog- (belfastbullies2.blogspot). The ordinance proves the corrupt drowning of Seaview Terrace and watershed residents. Sending runoff to private property and destroying value and our lives. Just sent below to Mayor Ash, City Manager, Council, Assessor, Brenda Keilty- Maine AG office for FOIA- proves that Mayor Ash does not care for the community at all, but allows abuse, corruption, intimidation, (Council called ME in as a threat to the Chief of Police), force drowning, and on and on and on. Even refusing my AAA emergency calls at his East Side garage. You Mayor Ash have advised me to get an attorney to speak for me. I welcome any interested attorney's to contact me via email.

Please have copies of these documents for me and have the map available for viewing. Bob Whiteley must be present to validate documents. No one else is knowledgeable and trust worthy. The City Attorney has more or less written that I am too ignorant to know the seal of the final approved site plans. Wayne has removed documents, you have with held documents- including the 1987 engineer report on my property and the original plans to the development of Seaview Terrace and on the email below, are clearly lying to me on several points- most disgusting is your insistence that my man made drainage ditch for MY property only is a natural stream, natural outlet and according to ordinance you are sending all this runoff from outside Seaview and inside Seaview to my private property. You, Wayne and Todd are not valid people. Jamie is biased. Bob is the only one- he is independent.
1. All documents and results of offsite drainage study to the unnamed stream's watershed ( in your email you clearly state that my property acts as the watershed- it must be included in the overall. If the study has not been completed- it is violating compliance of site plan- advise of penalties and resolution..
2. Final Approved Site plans for CASS where the Robertson School was NOT demolished. Every document I reviewed had this school demolished-" The project also involves demolition of the existing Robertson Elementary School and the conversion of this former school site to an athletic field...." Certainly this is a huge change in the approved plans- ground absorbing athletic field to impervious ground. These plans will also show the detention pond and the unapproved outfall being sent to watershed residents. I had visited prior and were shown plans where the school was demolished. They must be final approved- Bob will verify. Wayne has provided false plans 2 times and no one reliable or knowledgeable to witness.
3. The letter from the licensed engineer or the report from the City engineer for the construction of stormwater improvements. "Provide the City a letter from a licensed civil engineer certifying that the stormwater improvements were constructed in accordance with all City specifications and in accordance with Site Plan requirements; or b) Pay the City the cost to employ a City inspector to inspect construction of the stormwater improvements."

I did some research, first the Zoning Conditions of Approval document indicates that the CASS school is responsible for snow removal. Any potential violations of this document would be a zoning issue handled by the board or by the code enforcement office. We as Police would have no authority over this issue unless a state law or local ordinance was violated. There are no state laws or ordinances enforceable by the Police Department which would prohibit the school from removing snow from the parking lots or events/sporting fields in the manner in which they are currently doing it.2013-03-20 spring2013vio

I am taking your concern seriously but unfortunately it is not the only concern that I have to address right now. I am taking the liberty of sharing this email with Belfast City Council.
I spent over an hour at your house Tuesday and walked the stream and listened to every concern that you have raised. I see no sign of imminent danger to your property and as such I can not justify treating this matter as though it was an emergency and push my other responsibilities to the side. The stream itself is about 4 feet deep and about 8 feet wide and was essentially dry. It has the same shape and level of erosion along its banks at every point where I observed it. It is essentially dry and I saw one - one inch puddle in a 100 foot walk that I took through it You identify no damage or threat to your house but you are very upset by the erosion in your back yard. I saw this erosion and while there is some there, the scale and scope of it was far smaller then I imagined from reading your emails.
You have raise multiple concerns and it is very clear that you are extremely focused and upset by both the erosion situation itself as well as the treatment you feel that you have had at the hands of the City in responding to your concerns. Your letter today is indicative of your anxiety and expectation of immediate need for answers which is not consistent with what I said to you on Tuesday. I advised you that I was going to look into this and that it would take some time. I told you that I would attempt to summarize your concerns in the next day or so. That is -I was going to make sure I had a complete list of your questions and concerns. I never said I would resolve all of your issues in a day and a half. I said I would get back to you and I am sorry if 48 hours is worse for you than 36 hours.
When I told you that I would get to the bottom of this and that I would be thorough-you asked me how far I had to go in terms of information gathering to get this resolved. I said right there that I could not see anything-- based upon my visit that day-- that suggested to me that the City had done anything to harm you in any way. I absolutely did see some erosion along the stream bed which in my personal opinion is the same condition I would see along any stream bed and which in my experience such erosion often happens if there is an unusually large storm or runoff like the ones we have had in the last several years. Secondly I told you that would have to go deep into City records to find whatever I could that would help bring all the truth to this issue that I could find. I said that no City record was a secret and I would try to find them and make them available to you. I also reiterated what you said Wayne had mentioned to you previously--- If you feel that the City has in any way caused you damage then please send me a letter or note identifying what you believe to be the extent of your damages and I will be pleased to promptly send your claim in to our insurance carrier who might also investigate this claim and provide their perspective.
Here is where I am on your issues:
1. The Culvert under the road which brings the stream from one side of the road was simply installed to allow the road to go over the stream.
2. I do not believe the City created this stream. Before I left I suggested to you that it looked like a natural stream to me and the fact that DEP has jurisdiction -as you advised me -over this stream means to me that this is a natural stream. Natural streams have flows that vary with the weather which based upon conditions can cause erosion. This is true of every river and stream I have ever seen.
3. I have now seen aerial photographs of your area before the road and houses were built on your street and the stream is clearly visible. I can show them to you at any time.
4. I am working on getting you a copy of the framed map in the Planning Office that you have asked for which shows this and other protected streams. I may have to have it professionally reproduced and I will do that at City expense and get it to you as soon as I reasonably can but that could take some time- I do not know at this point. In the meantime the copy we have is not going anywhere and I can give you access to it at any time until you get your own copy.
5. I have not had the chance to meet with Bob Richards on this matter from Public Works since I met you Tuesday to find out whatever he can tell us about culvert history etc. I will let you know everything I find out. This relates to your concern that the City has taken a series of actions which have unnaturally increased the flow in this stream that you believe is the reason you have some erosion. The stream is about 75 feet behind you house. The only indication of potential City contribution you showed me is a couple of culverts crossing underneath the road which would clearly carry some surface water from the south side to your north side and which if significant in volume would reach the stream by following what appear to me to be human made ditches that run along the westerly line of your property and to along another property uphill and west from you. I did step into the ditch along your property in my loafers and found no evidence of water or even mud in this ditch. I do think we have to ask ourselves where this surface water all went before there was a subdivision? My thinking is that it puddled where flat or ran downhill into the lowest point in this area which upon my inspection is this stream.
6. You told me that all the houses on your street have water issues, This tells me that the ground water is close to the surface so when it rains there is more surface water to address because less can be absorbed. I would expect both groundwater and surface water to work their way into this stream.
7. Regardless, I will inquire about any information the City has about letting people ditch or drain to the stream or of people just doing it themselves. When you told me that your house was nice and dry because you had a good drainage system and sump pump I assumed that since there are no storm drains on Seaview Terrace that your building and property drains also go into this same stream.
7. I do not know what all the rules are for private people sending their surface or ground water into natural streams but I do not think the City is responsible for what private people do. I do think the City has the right to maintain its road and to use its right of way to get water away from the road in order to protect it.
8. Where to from here? Speak with Bob Richards, identify any records we have that you want a copy of and get them to you. Identify anything I can which leads me to agree with your assessment. Presently I am unable to do this and if that is where my review concludes then I will not support the City doing remediation on any private property for harm or damage that we did not cause. I want to speak with the State DEP. They called me likely at your suggestion but I have not had a chance to speak with them yet. I welcome their inspection, input and perspective.
9. Seaview Terrace is a City road and I need to find out how wide our right of way is.The City does have the right to shed water away from its roads to protect them from the kind of damage we saw Tuesday. I may also call the City Attorney to secure his advice.
10. I did not plan on taking any pictures of your stream or your erosion but I am thinking that now that would be a good idea so that we can have a good record of the extent of your concern. I will call and find out when there is a time that will work for you. I am not going to send Ned Lightner based upon what I saw with my own eyes and what a regular camera will readily confirm.
I understand that in not immediately agreeing with your concerns that this is causing you some distress. It may well be that given the intensity of your frustration and concern that I may not be able to meet your expectations.
If you need an answer today as to whether the City will pay or fix the erosion in the back of your yard then my answer would be "No" for all the reasons recited above. If you are willing to be a little more patient then I will continue to investigate for any City activity which makes us liable for you damage.
I will talk to Wayne Marshall about some site visit that he had previously scheduled and perhaps we can make that happen in the next few business days to clear up as much as we can. Next Wednesday I have to attend a family emergency in another state where I plan to stay for a week. After that I have a training conference when I get back. If we can't conclude this matter by Tuesday I will be unable to get back to it until the 29th.
Again I will leave it to you as to whether you wish to file a claim with our insurance company.

10/18/13-Bottom line- this ordinance proves Belfast Corruption- I have proven against every abuse thrown at me that this "stream" running through Seaview Terrace flood zone private property is not a natural outlet. It is not a natural stream. It is a man made ditch done at development of Seaview Terrace in 1967, approved by the City of Belfast and possibly actually done by the City. The DEP mandating that this man made ditch as"wetlands' is ridiculous and also corrupt . Here is the ordinance that Belfast is using to destroy us though apparent Inverse Condemnation as well (No rights of ways or easements. They also deny sending us all this visible force channeled runoff from miles outside of Seaview Terrace and unsuccessfully tried to bury the paper trail from Courageous Cat - me)

1. September 2009 -Jan Andrews of BHG Town and Country began sending me listings in Belfast, Maine. I was in NJ but had a home in the next town over in the village of Bayside, Town of Northport since 1967.
2. My number one concern was water- no water issues. Refused listings with streams and came to see 5 showings in 12/2009. I ran from each showing with water in basement, foundation issues and have in writing refusing a property because of the stream.
3. At the showing for 17 Seaview Terrace (T&C Bill Ingersoll the listing agent) on 12/29/2009, 3 inches of snow had fell the night before. We went straight to the backyard- inspected the deck and the back yard was level with snow. No stream disclosed. No stream visible.
3. A home on High Street was my choice. Jan quickly dismissed that home, claiming she saw mold on a wall (she did not point that at to me during the showing and I did not see any mold.) This house was not listed by T&C.
4. 2/2010-4/2010- Repeated requests for concern for 17 Seaview Terrace- why was it on the market for so long, are there any water issues, Rte 1 too close, upcoming construction, does the City maintain the roads, any reason at all that I would be sad to have bought this home. None- best value in town and great price due to slow market. Seller just dropped another 10k, getting traffic, better act quickly.
5. April 2010 I want a property inspection done. Jan recommends DJ Brown of China Me. Jan is working from Florida and I am in NJ. Sam Mitchell of T&C is present for the inspection. This is in April, spring thaw. The stream was not disclosed nor the unstabilized banks. The property is only 1/4 acre. There is a stake across the stream that Bill Ingersoll knew exactly where it was when I asked him where my property boundaries were a week after closing, 7/2010. He hopped the then deep ditch- it was dry- I still didn't know it was a stream, and showed me the stake.
6. June 2010, sell my NJ home, close, move and close on 17 Seaview Terrace within one week of each other.
7. Dry summer, growth over banks, begin working full time, underway with court proceedings in NJ for contested relocation of children. I never saw any stream.
8. April 2011, water is like rapids, thunderous- I can see it cresting from my back deck door. My neighbor (also new- from Alaska) came out to see what the noise was from. Shocked to see the torrent water. It flowed for a week.

City allows site ordinance violations causing devastation to Seaview 2009 & 2011. City refuses to do the Storm water analysis as ordered in the conditions for approval. Wayne Marshall took the funds from the contributing storm water sites and there it stopped. Joe Slocum refuses to implement. Do they plan to let Seaview get wiped out and take it through imminent domain? Additionally, sites are to remove snow off site and not pile per local ordinance. Winters of heavy snow keep increasing pile...

Per Local Ordinance, the Code Enforcement Officer is not issuing violations that are flooding our floodplain, flood zone neighborhood of Seaview Terrace. We have confirmed the CASS and Annex are in violation and the other sites need confirmation so that police power may protect the flood plain as our local ordinance dictates.
Drainage. Adequate provision shall be made for stormwater, with particular concern for the effects of any effluent draining from the site. Erosion resulting from any improvements on the site shall be prevented by landscaping or other means (see sections 102-1123 and 102-1124 and chapter 98).
j.Snow removal. The plan shall provide for storage of snow accumulation or removal from the site.
Floodplain and floodprone area mean any land area susceptible to being inundated by water from any source (see definition of "flood" and "flooding").

Floodplain management means the operation of an overall program of corrective and preventive measures for reducing flood damage, including but not limited to emergency preparedness plans, flood control works, and floodplain management regulations.
Floodplain management regulations means zoning ordinances, subdivision regulations, building codes, health regulations, special purpose ordinances, such as a floodplain ordinance, grading ordinance, and erosion control ordinance, and other applications of police power. The term describes such state or local regulations, or any combination thereof, which provide standards for the purpose of flood damage prevention and reduction.

10. City Hall knows this stream is not natural. A blind name could feel it's not natural. The sides are all soil- huge boulders piled up on the opposing bank. The City hides the original plans showing the stream/ditch/swale what ever it was, was moved at development- 1966- pushing it back some 70 ft and not stabilizing the banks. However, they do not tell me and remove the plan from the deeded registry and hide it. Until I came in for a surprise visit, end of November 2011, to the Tax Assessors office and Bob Whitely had it spread out on the counter. The stream was moved. For 7 months City Hall and City Council were shoving it down my throat- 100 year natural stream, natural runoff, mother nature... It was not and they kept sending me down rabbit hole after rabbit hole, trying to break me. Click on the page for MFOIA and you will see a small sample of the manipulation, intimidation, and extortion for requests for simple documents. SEE THE LETTER FROM CITY ATTORNEY BILL KELLY TELLING ME THE CITY WILL NOT GET ME DOCUMENTS! I finally went out and tracked the water on my own and drew a forced storm water map to Seaview Terrace. It may be even missing a few- Public Works on Congress St.? Townhouses on Cedar St? It is in the picture album below titled History of Seaview Terrace- I'll try to post the map by itself as well.
This is the ordinance that they tried to use as approval to drown us. NOT A NATURAL OUTLET- NO RIGHTS OF WAYS- NO EASEMENTS.
Stormwater and all other unpolluted drainage may be discharged to such sewers as are specifically designated as storm
sewers, or to a natural outlet approved by the city. Industrial cooling
water or unpolluted process waters may be discharged, on approval of
the city, to a storm sewer or natural outlet, if in accordance with regulations of the state department of environmental protection.

11. The City also broke ordinance by working on private property @ 23 Seaview Terrace. Over and over, "The City is precluded for doing any work on private property..." Joe Slocum uses that. Backing it up the City Attorney's stupid letter, dated 12/27?/2012 (also in picture 1/31/13). The flood of 2009 to Seaview Terrace almost took a car, a home, overflowing yards across the street into opposing yards and homes. The ditch at 23 Seaview Terrace was dug deeper in 10/2009 to allow accumulating water from 27 Seaview Terrace to flow under the road, through 23 Seaview Terrace via the ditch and into my property. City Manager and City Planner denied and denied. I asked to see the work orders for the heavy equipment, I was told work orders are not used. I gave written testimony from a witness. Then City Manager, Joe Slocum said the work was done 8 years prior (to avoid statutes) I have it in writing. Then I show the proof that it was done in 2009 and he changes his facts again. Stating yes, ok it was done in 2009 but it was done to save the road. This ditch is nowhere near the road. there is a culvert under the road, so the drop down is at least 2-3 ft. That is probably the ONLY spot where water is not accumulating roadside. He is a liar, over and over. Wayne Marshall also caught lying and hiding documents. The road is shot. Joe Slocum said it was from all the water and no drainage. He refuses to fix the road. He is a liar.
10. Through the summer, volumes of emails, nothing resolved, requests for specific stormwater ordinance, maps, development of Seaview Terrace history denied. Tainted by confusing irrelevant responses. Refusing to answer requests in writing- see pages above. Not allowing an agenda for Seaview Terrace at City Hall. Instead forcing a street sham of a meeting, neighbors had to take off from work, another had to hire a nurse because she was caring for hospice patient in her home... The City Planner, Wayne Marshall and Director of Public Works, Bob Richards were not forthcoming with any information. City Council creating detours, supporting the City, slanderous statements against me on public TV and then taking the 5th.
12. DEP Chris Cabot was at the sham too. I had been informed that this stream was wetlands and I had been trying to get information from him, emails from 6/2011 on. To no avail. I specifically asked him which approved developed sites were draining into this stream. I had testimony that the Captain Albert Stevens School was the most recent and had many issues with abutters and stormwater runoff. He did not respond to CASS at all. And that turned out to be not in compliance, an secret illegal outlet in the huge detention area was draining to Seaview Terrace. When the DEP. Tom Gilbert finally did the investigation in 8/2012- he did not report the illegal outlet. I gave him the exact location, it was clearly visible, and he tainted his report. Found the site in compliance.
13. Also in violation of compliance was the failure to implement the storm water impact study to the water shed residents. Ordered by WRBC Engineers when a change of plans where the Robertson School would NOT be demolished. This is a small one floor school at the bottom of the huge site. Since it would now have impervious ground, that runoff only would go to an "un-named" stream pending the impact study. Contributors to the "un-named" stream would pay for the study. Fees collected and City Planner Wayne Marshall and City Manager Joe Slocum refuse to comment on study and if it was ever done.
The corruption with CASS needs a blog of its own. Prior to my public inspection of the files for stormwater documents, City Planner, Wayne Marshall removed every document. He gave me 4 or 5 huge, thick files. I went through page by page. Took me approx. 4-5 hours. I asked Wayne where the abutters concerns were, where were communications on the storm water- he said there were none. They simply dug a ditch for Mr. Sanderson (now admitting to doing work on private property) I found a few vague references- one 10 page document stating all runoff from CASS was to flow via the million dollar sewer improvements to handle CASS runoff via Miller St to the bay.
I was not allowed to have the copy on the spot. When I came back the next day, that particular page was not copied. I asked admin asst. Marie Stalworth to find the original document. After an extensive search, she could not. It went missing. I asked to see the files again and inside was a bonanza of stormwater documents, abutters concerns, engineers notes, recommendations, emails, Army Corp, DEP, on and on and on. That site was a swamp, a huge swamp. Drainage a huge issues. Wayne is a liar and corrupt to the bone. I demanded copies on the spot of a few key documents- including WBRC ordering the impact study. Enough to prove corrupt non- compliance. No one investigated, Council and City Wall Hall taking the 5th.

14. Complaints to DEP Commissioner Aho for non compliance of CASS site and corrupt investigation by DEP Tom Gilbert were dismissed. Case Closed.

16.Sites contributing to the un named stream (about 10-12) stock pile snow all winter wiping us out, a flood plain, flood zone in 2009 and 2011. City Hall knows it is because they are not enforcing site conditions specifically stating that plowed snow is to be removed offsite. Confirmed with the Chief of Police, Mike McFadden. He was able to access to those conditions that City Hall is refusing to provide to me. Officer Ward witnessed the plowing and piling of snow at the Annex- 1/2013. See the photo albums 1/31/13 contains some City Attorney Unethical Letters and other documents and pictures.The 3/20/13 proves the blatant disregard for Seaview Terrace and safety of residents. I had proved months prior that they were not removing the snow. Thinking the next snow, they would have to do it now....NOT, (see pictures in album above)

allowing for an open forum, and yet another with held vital document
revealed. A City biased engineers report from 1987(copy in the 1/31/13 album) and City Manager to
deny flooding back then to the original owner of this house Dr. Caswell.
Seems the flooding began in the late 70's- what sites went up in the
70's- The Hilltop Birches/ Belfast Birches...and more to come over the
next 35 years, all draining to our private property. Some 240 acres of
absorbing ground turned impervious. No planning for sewers. Send it to
private property and deny it. Make their lives hell for ever trying to
prove one ounce of corruption. Bring in all the forces against the
resident. Crush, flood, destroy, deny.
18. I filed a complaint with the State Realtor Board for non-disclosure and volumes of supporting proof in emails and the property inspection. Open and shut case. Not in Maine though, 4th in corruption, little me against Earl Black, probably owns half the agencies in Maine. Sure would be bad for business to find his agency corrupt. I had to file it as a formality, I have no doubt the will find no violations. It is the State. You can view the complaint on line. Not all the documents are on there, but certainly enough. Failure to disclose stream/swale/ditch with unstabilized banks- raining that day too when inspection done- stream visible yet not reported.

20. Mayor Ash is also the nearest AAA garage provided. My last 3 emergency calls were declined. One for a dead battery resulted in my son being 2 1/2 hours late for school. Another was a lock up ice slide down Park Row in Bayside. A snowbank just stopped me from going into the Bay. One tire hanging over. After a freezing hour of waiting for a Searsmont tow, a hero named Fawn called her step dad to come pull us out. She waited and tried to help me out the entire time.
21. Dale Rowley of Waldo County EMA states to date the City of Belfast has not requested for Seaview Terrace to be on his radar with a mitigation plan. I spoke at the same meeting where Dale was asked to give a presentation, asking to be on his radar. Without a request from Belfast, he cannot. City Council did not request or ask any advice for the flood zone, flood plain of Seaview Terrace, in grave danger from forced City water from miles around. True to form, Council Mike Hurley prattles about the new building, equipment, such charming small talk as I am begging for us to be saved.
The unethical and unprofessional bullying tactics used are off the charts. The City Attorney send personal attacking letters, alienating me from neighbors/community, trying to stop me from speaking at meetings, my council calling me in as a threat to the Chief of Police, public discrediting me, hiding documents, threatening to charge me huge sums of money to research requests for information that may not exist (that's a beauty) claiming I've been given the documents but am too stupid to know what I am looking at, refusing to include us in a mitigation plan with Waldo County EMA, scaring me and intimidating me to where no one will help me, I've burned bridges recently with The Chief Of Police, Pen Bay Pilot (on line media), I am taking personal attacks from people I don't know on facebook and in opinions in the paper, neighbors are upset that property values are diminishing. businesses are angry when I protest in town, it blends into the schools, the ethics are non-existent.

Maine got an F in nine of the 14 categories, including executive accountability. A problem that contributed to that score was that fact that no agency oversees the ethics of top-level state officials, from the governor to department heads, from the attorney general to the state auditor.
It also got F’s in public access to information, civil service management, pension fund management, the insurance commission, legislative accountability, lobbying disclosure, ethics enforcement and redistricting.

Abstract:
Purpose – This paper aims to assess highly toxic personality disorders in leaders, implications for organizations, and methods for assessment and intervention.
Design/methodology/approach – Action research was used, including a thick description case study narrative and application of the DSM IV-TR.
Findings – Personality disorders are a source of a highly toxic and dysfunctional organizational behavior; borderline personality disorder in a leader may serve as a systemic contaminant for an organization.
Research limitations/implications – A qualitative, case study approach may not lend itself to replication or quantification; usage of the DSM IV-TR requires clinical training in counseling psychology; the growing incidence of personality disorders in leadership warrants cognizance, ability to assess, the creation of early detection systems and methods of intervention.
Practical implications – Through the narrative of a case study researchers and practitioners can obtain a glimpse into the day-to-day operations and nuances of a highly toxic leader and how it impacts an organization; interventions and solutions are provided.
Originality/value – This paper calls attention to highly toxic leadership and organizational dysfunction by investigating borderline personality disorder as a prototype.

The Costs of Public Corruption – And The Need for the Public to Fight Back

...Corruption can also change the face of a community. Over and over, for several decades, some Chicago aldermen have given away public benefits, like zoning rights and city-owned land, to real estate developers who, in turn, have lined the aldermen’s pockets and campaign purses.
Undoubtedly the most harmful consequence of endemic public corruption in a community is the apathy that it engenders – the culture of acceptance. Over many years of seeing corruption in almost every facet of government, many residents of a community begin to simply accept corruption as the immutable status quo. They come to assume government is broken and ineffective and destined to function corruptly. The consequences of this culture of acceptance in a community are many. Some residents simply disengage from the political process and no longer trust their government to function well or in their interest. Other residents may come to believe they must engage in corruption in order to gain government benefits themselves. Still others will begin to look the other way when they witness corrupt transactions. And honest folks are discouraged from entering politics or suffer from the skepticism engendered by others’ misdeeds.
The culture of acceptance makes it very difficult to detect, investigate and prosecute corruption. Although there are a variety of federal statutes that we use to prosecute corruption, including fraud, bribery and extortion statutes, as well as RICO, prosecutions cannot be successful without truthful witnesses and willing cooperators. Because voluntary assistance from the public in corruption cases is often hard to come by, we use many investigative techniques that assist us in gathering evidence and requiring cooperation, such as the use of grand jury subpoenas, grants of immunity, consensual recordings, and wiretaps. Using a wide range of these tools to vigorously investigate corruption can lead to convictions of corrupt officials once thought to be above the law, which, more effectively than anything else, demonstrates that the public need not accept corruption. Successful prosecutions that show that no one is beyond the reach of corruption statutes serve to encourage, empower and mobilize members of the public to work to change the culture of acceptance. We are grateful in the Northern District of Illinois that juries time and time again have rejected the argument that corruption is acceptable because it is the “Chicago way.”
In addition to the need for effective prosecutions, federal prosecutors must engage in community outreach to ensure that all residents of a community know that they can have a voice in stopping corruption and that they need not accept corruption in any degree—at any level of government. In the Northern District of Illinois, we try to send the message as often as we can that community involvement is critical in rooting out corruption. We regularly communicate that residents must take an active role in their government so that it properly functions for them. We also emphasize that the vigorous efforts of law enforcement should not be used as a rationale for the community to stay silent. The public’s refusal to accept corruption is the first line of defense in the fight against it.
While corruption will never be eliminated from our communities, vigorous investigation and prosecution of corrupt officials can serve to reduce its harmful effects and, most importantly, greatly diminish the culture of acceptance.

We are grateful in the Northern District of Illinois that juries time and time again have rejected the argument that corruption is acceptable because it is the “Chicago way.”
In addition to the need for effective prosecutions, federal prosecutors must engage in community outreach to ensure that all residents of a community know that they can have a voice in stopping corruption and that they need not accept corruption in any degree—at any level of government. In the Northern District of Illinois, we try to send the message as often as we can that community involvement is critical in rooting out corruption. We regularly communicate that residents must take an active role in their government so that it properly functions for them. We also emphasize that the vigorous efforts of law enforcement should not be used as a rationale for the community to stay silent. The public’s refusal to accept corruption is the first line of defense in the fight against it.
While corruption will never be eliminated from our communities, vigorous investigation and prosecution of corrupt officials can serve to reduce its harmful effects and, most importantly, greatly diminish the culture of acceptance.
